MaindMe Service Terms of Use

General Provisions

  1. These Terms of Service (hereinafter referred to as the “Terms”) define the conditions and rules for using the MaindMe service (hereinafter referred to as the “Service”), available at www.maindme.pl and maindme.web.app, provided by MaindMe – the brand belongs to SteelCo Group, NIP: 9511951267, based at Sarmacka 1/38, 02-972 Warsaw, Poland (hereinafter the “Provider”).
  2. The MaindMe Service involves submitting questions and generating answers based on artificial intelligence models available on public platforms such as OpenAI, Vertex, or others using APIs. The Service may also use additional knowledge sources and tools made available to the AI model by responsible third parties.
  3. Answers are presented without the Provider’s interference in their content.
  4. Along with the user’s query, the Provider submits a definition of communication style and personalization, as well as additional informational resources developed specifically for the MaindMe service, which constitute the Provider’s unique intellectual property and trade secret.
  5. The Provider does not process users’ personal data or IP addresses in the Service’s database in any way other than as necessary for the provision of the Service. IP addresses and other necessary data may be processed by technical infrastructures provided by third-party vendors such as Stripe (payment processing) or Google (technical infrastructure) and their affiliates.
  6. All payments related to the Service are handled by the external payment provider Stripe, Inc. (“Stripe”), which serves as the controller of personal data related to payments.
  7. Users must respect the rights of others and use the Service in a lawful manner, following good practices and these Terms.
  8. Answers generated by the Service are intended solely for informational and educational purposes and must be verified with a professional expert. It is the user’s responsibility to do so. The Provider is not liable for any damages resulting from the use of the answers or for their substantive accuracy.
  9. The Service is available to individuals aged 13 and above. Persons under the age of 18 should use the Service with parental or legal guardian consent and under their supervision. Use of the Service by a minor implies such consent has been obtained.

Service Availability

  1. The Provider makes every effort to ensure continuous access to the Service. In the event of a service outage, the Provider is not liable for any direct or indirect consequences.
  2. The Provider will notify users of any known major or long-term outages via the website, stating the cause and estimated restoration time.
  3. The Provider reserves the right to change the AI models used during the course of service provision. This may require updates to these Terms.
  4. The Service does not provide access to detailed conversation histories after a session ends. With user consent, summaries of completed conversations may be created. Users can view and delete such summaries.
  5. The Service stores conversation histories for the purpose of improving service quality.
  6. In case of service unavailability during an active session, the user may request a refund of the points used to initiate that session. Requests can be sent to: contact@maindme.com. Refunds are issued in the form of points that can be used for a future session. The Provider does not issue cash refunds. 

Payments

  1. User payments are processed via the Stripe platform, which manages the data necessary for completing transactions.
  2. Access to answers within the Service is granted through the purchase of sessions tied to a user account identifier (Account ID).
  3. Due to the nature of the Service, users waive the right to withdraw from the contract, in accordance with regulations regarding digital services delivered immediately after purchase.
  4. According to consumer rights law, users who are consumers cannot withdraw from a contract for digital services not provided on a tangible medium, if the service began with their express consent before the withdrawal period ended, and they were informed that this would result in loss of withdrawal rights.
  5. By purchasing, the user agrees to immediate service delivery by the Provider, thereby waiving the right to withdraw.
  6. Unused time from a session is not carried over to subsequent sessions. Unused sessions may be deleted from the user’s account 6 months after the purchase date if they remain unused, and users will not be notified of such deletion.
  7. The current offer terms are published on the Provider’s website and shown prior to redirection to the Stripe platform within the application. 

Free Use of the Service

The Provider may offer free trial responses or conversation sessions for new users or during promotional periods. Trial responses may be provided through a limited number of question-answer iterations for demo accounts, or by assigning a limited number of time-bound free points that allow full functionality during conversations.

Satisfaction Guarantee

  1. The Provider offers a full satisfaction guarantee for conversations conducted with AI specialists using the Service. If the user is dissatisfied for any reason, a refund of paid funds may be granted.
  2. Refunds apply only to unused funds or those for which dissatisfaction has been reported. Previously used funds cannot be refunded.
  3. If a package was purchased that includes bonus (free) sessions, promotional sessions are used last. A satisfaction guarantee cannot be claimed during the use of bonus sessions.
  4. To request a refund, users must send an email to contact@maindme.com within 7 days of identifying dissatisfaction, including the email address used for the session purchase.
  5. Upon refund, all unused sessions are removed from the user’s account.
  6. The satisfaction guarantee does not cover free or trial sessions.

Personal Data Protection

  1. Using the Service may involve the processing of user data, such as IP addresses, by infrastructure and technology providers (e.g., Google, Stripe). The Provider has access to data generated during Service provision.
  2. Users agree not to submit any personal data of any individuals when using the Service.
  3. Detailed data processing information is available in the Privacy Policy. 

Use of Messages

  1. The Provider will not use the content of conversations and messages for any purposes other than those necessary to provide the Service.
  2. Users may voluntarily share their conversation content with others.

Limitation of Liability

  1. Users use the Service at their own risk. To the extent permitted by law, the Provider is not liable for any damages arising from the use or inability to use the Service, including damages due to mismatched AI responses and user expectations.
  2. The Service is for informational and educational purposes only and uses publicly available solutions. It is not intended to replace professionals, diagnose conditions, or provide medical advice or consultations. It does not provide health services.
  3. The Service is intended for personal use only. It may not be used by automated systems or for commercial purposes beyond individual conversation generation (e.g., large-scale content creation). The Provider may revoke access to the service in case of violations without notifying the user. No refund is granted in such cases.
  4. The Provider is not responsible for content generated by AI models, including its factual accuracy, legality (including copyright), or social appropriateness. AI-generated responses are not verified or modified by the Provider. 

Intellectual Property

All elements of the Service, including the website, content created by the Provider, logos, and trademarks, are the property of the Provider or their respective licensors. Unauthorized copying or use without the Provider’s consent is prohibited.

Communication Standards

Users agree to maintain respectful communication, avoiding offensive, hateful, false, or rights-violating content.

Change of the Terms

The Provider reserves the right to amend these Terms. Users will be informed of significant changes via the Service website.

Acceptance of the Terms

  1. By using the MaindMe Service, the user declares that they have read, understood, and accepted these Terms.
  2. Use of the Service must not violate the terms of use of third-party providers, which the user agrees to by accepting these Terms.
  3. If the user violates these Terms, the Provider reserves the right to take appropriate action to ensure compliance.
  4. Penalties may include but are not limited to:
    • temporary or permanent restriction of access to the Service;
    • user account suspension;
    • pursuing claims for damages.

Final Provisions

  1. Matters not covered by these Terms are governed by Polish law.
  2. These Terms fully comply with applicable legal regulations and good market practices.
